Terms of Service

These Terms of Service ("Terms") are an agreement between you and Fork & Follow ("Fork & Follow," "we," "us"), run by Nygle Gillett in California. They cover the Fork & Follow app, forkandfollowapp.com, our /r/ and /go/ links, promos, and the restaurant and creator tools (the "Services"). By creating an account or using the Services, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the Services.

1. Who can use Fork & Follow

You must be at least 18 years old and able to agree to these Terms. You're responsible for your account and for keeping your sign-in secure. Give us accurate information, and tell us if you think someone else is using your account. One person per account, and you may not sell or transfer your account.

2. What the Services do

Fork & Follow helps you save restaurants, sort them, see them on a map, get reminders when you're nearby, check in, and claim restaurant promos. Restaurant details such as names, addresses, hours, ratings and "open now" status come from third parties like Google and from restaurants themselves. They can be wrong or out of date. Always check before you go, especially hours, prices, menus, allergens and accessibility. We may change, add or remove features at any time. The Services are free right now. If we ever charge for something, we'll tell you the price before you pay.

3. Location, notifications and safety

Nearby search, reminders, check-ins and promo claims need your location. You control location and notification permissions in iPhone Settings and in the app. Reminders depend on your phone, iOS, battery settings and your connection, so we can't promise every reminder will arrive or arrive on time. Don't use the app while driving. Obey traffic laws, private property rules and posted signs, and use your own judgment about where you go.

4. Acceptable use

You agree not to:

  • break the law, or use the Services to harass, threaten, defraud or harm anyone;
  • fake your location, create multiple accounts, or use bots or scripts to claim promos, inflate clicks, saves, visits or check-ins, or game creator attribution;
  • scrape, copy or resell the Services or their data, or call our servers more than normal app use requires (we rate-limit requests);
  • break, probe or get around our security, rate limits or access controls, or reverse engineer the app, except where the law allows it;
  • upload content you don't have the right to share, or content that is illegal, hateful, sexually explicit, or malware;
  • pretend to be a restaurant, creator or person you aren't, including in Instagram or restaurant claims;
  • use the Services to send spam or unauthorized advertising.

We may remove content, disable links, cancel promo claims, or suspend or close accounts that break these rules.

5. Your content

You keep ownership of what you add, such as your saved lists, notes and the screenshots you import ("Your Content"). You give us a limited license to host, process and display Your Content only to run and improve the Services for you. For example, we send a screenshot you import to Google's Gemini AI to read restaurant names (see the Privacy Policy). Only import screenshots you have the right to use. If you send us feedback or ideas, we may use them without owing you anything.

  • Links. Restaurant links (/r/) and creator links (/go/) open restaurant pages and give credit to the person or business that shared them. Following a link doesn't make us responsible for the creator's or restaurant's content, opinions or claims.
  • Creators. If you make or share /go/ links, you're responsible for your posts. That includes clearly disclosing any payment, free food or other relationship with a restaurant or with us, as FTC rules require. Attribution counts (clicks, opens, saves, visits, claims) are estimates. They aren't guaranteed and aren't a promise of payment unless we've agreed to that separately in writing.
  • Restaurants. If you claim a restaurant or link its Instagram, you confirm you're allowed to act for that business, and that its details are accurate.
  • Our control. We may review, change, pause, expire or disable any link or campaign, for example for misuse, inaccuracy or inactivity. If you delete your account, links, campaigns and promos you created may stay live and be managed by Fork & Follow, with your personal details removed, as the Privacy Policy explains.

7. Promos

  • Promos are offered by restaurants, not by Fork & Follow. The restaurant is responsible for honoring the offer and for its food, service and premises.
  • No guarantee. We don't guarantee that any promo will be available, accepted, or as described. A restaurant may end, change or refuse an offer, including if it ran out, the claim looks misused, or staff can't verify it.
  • Claiming a promo uses your location to confirm you're at the restaurant. It may be limited to one claim per person, may have time windows and other conditions shown in the app, and is void where prohibited.
  • Promos have no cash value, can't be transferred or resold, and can't be combined with other offers unless the restaurant says so. You're responsible for any taxes and tips.
  • Promo notifications are only sent if you turn them on in the app, and you can turn them off anytime.

8. Third-party services

The Services rely on, and link to, services we don't control, such as Apple, Google (Maps, Places, Gemini, Sign-In), Clerk, Instagram, TikTok and restaurant websites. Their own terms and privacy policies apply when you use them, and we aren't responsible for them.

9. Our rights

The Services, including the Fork & Follow name, the fork-in-map-pin logo, the app, the website and their design, belong to Fork & Follow and are protected by law. While you follow these Terms, we give you a personal, non-exclusive, non-transferable, revocable license to use the app on Apple devices you own or control, for your own non-commercial use.

10. Ending your account

You can stop using the Services at any time, and delete your account in the app (Settings → Account → Delete account) or by emailing us. The Privacy Policy explains what's deleted and what anonymous totals remain. We may suspend or close your account if you break these Terms, if we have to by law, or if we shut down the Services. If we can, we'll give you notice. Sections that by their nature should survive (for example 5, 9, 11 to 14) keep applying after your account ends.

11. Disclaimer

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT THE LAW ALLOWS, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. WE DON'T PROMISE THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE, THAT REMINDERS WILL ARRIVE, OR THAT RESTAURANT INFORMATION, HOURS, PROMOS OR AI RESULTS WILL BE ACCURATE. WE'RE NOT RESPONSIBLE FOR RESTAURANTS, CREATORS OR OTHER USERS, OR FOR THE FOOD, DRINKS, SERVICE OR PLACES YOU VISIT. YOU USE THE SERVICES AND VISIT PLACES AT YOUR OWN RISK. Some places don't allow these exclusions, so some of them may not apply to you.

12. Limitation of liability

TO THE FULLEST EXTENT THE LAW ALLOWS, FORK & FOLLOW AND ITS OWNER WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, GOODWILL OR OPPORTUNITIES, ARISING OUT OF OR RELATED TO THE SERVICES OR THESE TERMS, EVEN IF WE WERE TOLD THEY WERE POSSIBLE. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICES IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICES IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) US $100. Nothing in these Terms limits liability that can't be limited by law, such as liability for fraud, gross negligence or willful misconduct.

13. Indemnity

To the extent the law allows, you agree to defend and hold Fork & Follow harmless from claims, losses and costs (including reasonable attorneys' fees) that come from your misuse of the Services, Your Content, your posts as a creator or restaurant, or your violation of these Terms or the law.

14. Governing law and disputes

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Before filing a claim, please email us so we can try to resolve it informally. If we can't resolve it within 30 days, any lawsuit must be brought in the state or federal courts located in Los Angeles County, California, and you and we agree to their jurisdiction. Either side may bring a qualifying claim in small claims court. If you're a consumer, nothing here takes away rights you have under the laws where you live.

15. Apple App Store terms

If you downloaded the app from the Apple App Store: these Terms are between you and Fork & Follow, not Apple. Apple isn't responsible for the app or its content, has no obligation to provide maintenance or support, and, to the extent the law allows, has no other warranty obligation for the app. If the app fails to meet a warranty, you can notify Apple, and Apple may refund the purchase price (if any). Apple isn't responsible for any claims about the app, including product liability, legal or regulatory compliance, or intellectual property claims. We are responsible for handling them as these Terms describe. You confirm you're not in a country subject to a U.S. government embargo and not on a U.S. government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. Your use of the app must also follow the App Store's Usage Rules.

16. Changes

We may update these Terms. If we do, we'll post the new version here and update the date at the top. If a change is significant, we'll tell you in the app or by email before it takes effect. If you keep using the Services after a change takes effect, you accept the updated Terms.
